§ 1. Definitions
Contact Form - the form available on aitenmarketing.pl website to send messages to the Service Provider.
Order Form – the form available on aitenmarketing.pl to submit Orders.
Client – any entity using the Online Store with intent to enter or having entered a Sales Agreement with the Service Provider.
Consumer – any physical person entering a legal transaction with an entrepreneur not directly related to their business or professional activity.
Product – any physical good, digital content, digital service, or goods with digital elements available in the Online Store forming the subject of a Sales Agreement.
Terms - these Terms of Service for the Online Store.
Entrepreneur with Consumer Rights - a physical person entering an agreement directly related to their business activity when it does not possess a professional character for them, as determined in particular by the subject of their registered business activity.
Online Store - the Service Provider's online store operating under the domain aitenmarketing.pl.
Service Provider – Oskar Trojak, Krasińskiego 32, 42-202 Częstochowa, Poland, NIP: 5862351208, REGON: 384967954.
Sales Agreement – the Product Sales Agreement entered between the Client and the Service Provider via the Online Store.
Electronic Service – a service provided electronically by the Service Provider to the User via the Online Store.
User – any entity utilizing the Electronic Service.
Order - the Client's declaration of intent constituting an offer to enter a Product Sales Agreement with the Service Provider.
Contact Point - the designated channel for direct communication between Users/authorities and the Service Provider: kontakt@aitenmarketing.pl
§ 2. General Provisions
These Terms determine the conditions for entering Sales Agreements for Products, complaints handling procedure, right of withdrawal, as well as rules for utilizing Electronic Services provided by the Online Store at aitenmarketing.pl.
Every User is obliged to comply with the provisions of these Terms from the moment they take steps to utilize the Online Store's services.
In matters not regulated by these Terms, the provisions of applicable Polish law shall apply, in particular the Civil Code, Act on Consumer Rights, and Act on Providing Services by Electronic Means.
The Service Provider has designated an electronic Contact Point (kontakt@aitenmarketing.pl) for direct communication with EU member states' authorities, the Commission, and Digital Services Boards. Communication can be in Polish or English.
§ 3. Conclusion of a Sales Agreement
The Online Store conducts Product sales via the Internet.
Products are free from physical and legal defects. Technical compatibility and interoperability specifications are described in each Product offer in the Online Store.
Information on the store's website does not constitute an offer in the legal sense. By placing an Order, the Client makes an offer to buy a Product under the conditions specified in the store's description.
Product prices visible in the store are gross prices (including VAT) but exclude delivery costs.
The binding price is the price visible at the moment the Client places their Order.
Orders are placed by completing the online Order Form.
By placing an Order, the Client declares that they have read and accepted these Terms of Service.
If the Service Provider is forced to modify essential terms of the Sales Agreement prior to its execution due to reasons beyond their control, they shall immediately inform the Client. The Client may then accept the change or withdraw from the agreement with an immediate full refund.
The Sales Agreement is concluded when the Client places the Order (clicks the "Order and Pay" button or equivalent) unless otherwise specified in the Product's description.
Following an Order, the Service Provider immediately confirms its receipt and acceptance of the offer via an automated email sent to the address provided by the Client.
The confirmation email contains all essential elements of the Order, a copy of these Terms in PDF format, and details regarding the right of withdrawal.
§ 5. Methods of Payment
Payment methods for the Products are specified in the store's interface.
For electronic payments, the Client pays prior to Order execution. Electronic systems support credit card payments and instant bank transfers.
The Sales Agreement shall only be executed upon full receipt of the Price.
§ 6. Product Complaints
The basis and scope of the Service Provider's liability towards the Client are regulated by applicable laws on consumer rights.
Complaints must be sent via email to: kontakt@aitenmarketing.pl or in writing to the Service Provider's physical address.
Complaints should describe the issue, date of occurrence, and Client's contact info. The Service Provider will respond to complaints within 14 days of receipt.
§ 7. Right of Withdrawal
Subject to statutory exceptions, the Client has the right to withdraw from the Sales Agreement without stating a reason within 14 days of concluding the agreement.
To exercise this right, the Client must notify the Service Provider via email (kontakt@aitenmarketing.pl) prior to the 14-day deadline.
The Service Provider will refund all payments received from the Client within 14 days of receiving the withdrawal notice, using the same payment method unless agreed otherwise.
The right of withdrawal does not apply to services fully performed with the Consumer's explicit consent, customized goods made to specification, or digital content delivered immediately without a physical medium where the Client consented to immediate delivery and waived their right of withdrawal.
§ 8. Scope of Electronic Services
The Service Provider enables the use of Electronic Services via the Online Store, including placing Orders and concluding Sales Agreements.
Providing Electronic Services is free of charge and active for the duration of placing the Order.
Technical requirements: computer/mobile device, internet connection, active email, web browser with cookies and JavaScript enabled.
§ 9. Intellectual Property
All content published in the Online Store is protected by copyright and is the sole property of the Service Provider. Any unauthorized copying or commercial use is strictly prohibited and subject to civil and criminal liability.
§ 10. Product Reviews
The Online Store does not enable users to post product reviews.
§ 11. Final Provisions
Agreements concluded via the store are governed by Polish law.
Any disputes arising between the Service Provider and Consumers will first be resolved through good faith negotiations. Consumers have the right to utilize out-of-court dispute resolution mechanisms, including the European ODR platform: http://ec.europa.eu/consumers/odr/
